IBM sues company for selling fake batteries	28 November 2007
IBM is suing Shentech for selling laptop batteries that catch fire and sport allegedly fake IBM logos.The suit, filed Nov. 20 in the U.S. District Court for the Northern District of Ohio, accuses Shentech of trademark infringement, false advertising, unfair competition, and deceptive trade practices.IBM says that a consumer in Ohio bought a battery from Shentech for a ThinkPad laptop. The battery overheated and caught fire, causing damage to the laptop, IBM said. The user reported the problem to Lenovo, which licenses the IBM trademark. After examining the faulty battery, IBM discovered that it was not a genuine IBM battery, the company said in the suit.IBM then ordered 12 batteries from Shentech and found them all to be fakes, IBM said.IBM asks the court to require Shentech to turn over all of the batteries so that IBM can destroy them. IBM also asks for all the profits that Shentech earned from the sale of the batteries. In addition, IBM wants treble damages or $1 million per counterfeit mark per type of item sold.The Shentech.com Web site continues to list ThinkPad batteries for sale as well as a host of other electronic devices and components. Shentech appears to be a Web-only operation with a mailing address in Flushing, New York. It describes its secret to success as its "ability to provide cutting edge computer technology parts at bargain prices."No one from Shentech could be reached immediately for comment.

Red Hat made its Enterprise Linux OS available on demand Wednesday by releasing it for the Amazon EC2 (Elastic Compute Cloud) service that hosts business applications. The move is part of Red Hat's so-called "automation" strategy, which aims to deliver a Linux and open-source infrastructure for simplifying how applications run and are managed.A private beta of Red Hat Enterprise Linux on Amazon EC2 is now available with a public beta slated to be made available before the end of the year. The base prices for the service are $19 per month per user and $0.21, $0.53, or $0.94 for every computer hour used on the EC2 services, depending on the size, bandwidth and storage fees of the services purchased. EC2 is Amazon's Web-based service that hosts business applications for customers.Red Hat also released a new OS for delivering ISV applications on appliances on Wednesday and made available Red Hat Enterprise Linux 5.1 with improvements to its virtualization offering that extends support to virtual guests for Windows XP, Server 2000, Server 2003 and the Windows 2008 beta, the company said.Red Hat said its virtualization software is now being deployed on more than 18,000 servers, although company executives, speaking on a conference call, wouldn't say whether those servers were in full deployment or test environments. The company is under pressure to deliver virtualization for Red Hat Enterprise Linux that is on par with competitors.The new Red Hat Appliance OS will enable third-party ISVs to take their applications and customize and configure them on appliances they can sell to customers to run either in dedicated, virtualized or hosted environments. The software is expected to be available in the first half of 2008. The new appliance OS includes the Virtual Appliance Development Kit to help ISVs configure their applications to be run in an appliance container.Red Hat already offers the leading enterprise Linux OS in the world, but it is being pressured by Wall Street to take the company to the next level. To do this, Red Hat is trying to expand its offerings beyond enterprise Linux OS to avoid being a one-trick pony and stay competitive with the likes of larger software vendors like Oracle that are encroaching on its turf. The company purchased open-source Java middleware company JBoss last year as a part of this strategy.Red Hat ultimately wants to design an open-source infrastructure for delivering applications on various flavors of network infrastructure, whether they be delivered on virtual servers, dedicated services or so-called on-demand services clouds like EC2, said Scott Crenshaw, vice president of enterprise Linux at Red Hat. He said the company plans to build into the "fabric of the infrastructure" tools to manage quality of service, application mobility and availability so the infrastructure is as intuitive as possible for IT managers to navigate and manage.

Now that WiMax has been certified as a form of 3G mobile data infrastructure, Sprint Nextel is changing its tune about the WiMax network it plans to launch commercially in April.Last year when Sprint was shopping around for a "4G" technology, it had a lot to say about how 4G would do something 3G networks couldn't. WiMax won out as its 4G network of choice. But in a keynote address Thursday at CTIA Wireless I.T. & Entertainment in San Francisco, an executive of Sprint's WiMax business, Xohm, sang a different tune."I think we spend entirely too much time talking about the Gs," said Atish Gude, senior vice president of mobile broadband operations at Sprint. Last week, the Radiocommunication Sector of the International Telecommunication Union certified WiMax as a 3G technology, providing a seal of approval many governments require for carriers to deploy it. Wider deployment generally means lower equipment prices, which helps service providers.That's not to say the carrier no longer wants to differentiate WiMax. In his presentation, Gude played up the wide band of spectrum Xohm will be able to use, which he said will cut down on delays for individual users the same way a multilane freeway can move faster than a two-lane highway even when the speed limit is the same. In the real world, a lot of people want to use the network at the same time, he said.But more important is the business model of the two networks, Gude said, characterizing the traditional cellular business as more closed and controlled, while Xohm's business will tap into the dynamics of the open Internet. The company is opening itself up to partners for application development as well as connected devices, he said. The best known of these deals, announced in July, was an agreement with Google to develop a variety of Internet-based services.Sprint hopes a wide range of devices, including cameras, media players, and in-car electronics, ultimately will connect to the WiMax network. Instead of Sprint stores, they will be sold in the most logical places for their device types, such as consumer electronics stores. The first devices to come for Xohm next year will be wireless cards for notebook PCs, which Gude expects to be sold in the computer departments of electronics stores.The company will also have open API for third parties to develop services to run on the network. As an example, Gude envisioned a video portal that users could navigate using the five buttons traditionally found on video players. Xohm will probably charge for some of what it offers to third parties, but its aim is not to stifle innovation, he said.Sprint isn't getting out of its cellular business now that it's starting Xohm -- which it expects to reach 100 million U.S. residents by the end of 2008 -- but seems to be looking at it in a different light now."We are a content distribution industry," Gude said. It's just that for most of cellular's history, all the content has been user-generated and consisted of talking.
